Although the bill of rights were implemented to assure Americans of their rights, this has not always been the case. Often minorities are given these same basic rights or they infringed upon.
The fourth amendment, basically states that no one can search you, your property, or arrest you without a probable cause. This has been violated numerously among minority groups. The largest and most frequent violation of the fourth amendment occurs with ICE, immigration and customs enforcement. ICE frequently conducts unlawful searches people and their homes without documentation stating that they can without consent. Another frequent violator of the fourth amendment is the police force concerning police brutality. People of color are more likely to be stopped and searched by police just for the color of their skin than white people are. To summarize the fifth amendment, in order to be tried for a crime a jury must be present and you cannot incriminate yourself or be tried for the same thing twice. Along with this, no one will be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. A big case to come about this was Miranda vs Arizona which lead to the need for your "Miranda Rights" to be read when you are arrested. The sixth amendment, the accused shall enjoy the right to a speedy and public trial, in the district wherein the crime was committed, and to be informed of the nature and cause of the accusation. |
